How about F-1 with H-1 spouse?

I am on H-1B, with I-140 RFE not been responed. I want to file I-485 ASAP.

my spouse is on F-1 with 1-2 year to finish. Would he be out of status if my I-140 was denied.

does any one know what is my best option?
