yes or no, depends on judgement she received instead of the action she performed.

If she was convicted with Misdemeanor, like M-1, M-2. your case should be OK.
If shw was convicted with Felony, your case will be thrown out. Don't even think about.
If she is M-1 or M-2, you need to prepare for this case.
