H1 is different. F1 definitely

I don't know what lawyers you have spoken to. But F1 with 485 pending is much much more restrictive than H1.

There is even a debate whether or not F1 is still valid with a pending 485.

I think you are confusing H1 with F1. H1 is dual intent non-immigrant visa, but F1 doesn't have that luxury.
