One thing you may be wrong:

since your hu*****and file 485, so he is not F1 anymore.
if your 485 get denied, then he is also out of status.
This has nothing to do with using EAD or not.

This is the difference between H1 and F1.
For F1, if you file 485, then you are not F1 anymore.

This is just my comments, You better consult others.
