給大家提個醒 關於early termination 在lease上要嚴謹一些

我的不夠airtight，最近要吃虧了

正確的寫法是這樣的：

Early Termination by Tenant

 

If Tenant terminates this Lease before the expiration date, other than as permitted by law, Tenant must:

 

1. Provide at least 30 days’ written notice; and
2. Pay a one-time reletting fee equal to two months’ rent, which is intended to cover administrative, marketing, and re-rental costs and is not rent.

Payment of the reletting fee does not end Tenant’s rent obligation. Tenant remains responsible for rent until the earlier of:

 

• the date a replacement tenant begins paying rent; or
• the Lease expiration date.

Landlord will make reasonable efforts to re-rent the property. Tenant will not be responsible for rent after a replacement tenant begins paying rent.

 

No Buy-Out Right. This Lease does not grant Tenant an automatic right to buy out or terminate the Lease early by payment of a fee alone. Any early release, rent cap, or settlement must be agreed to separately and in writing by Landlord.

 

我寫了reletting fee但是沒寫reletting fee doesn't end tenants rent obligations. 讓人覺得可以buyout。在rental market比較弱的地方還是要多保護自己的利益比較好。
