I sit in the boardroom as a Finance rep. I can tell you how the decision is usually made, especially from financially perspective. Being sued by a former employee is for sure the lastthing company would like to face. A lot times the corporate lawyer charge is higher than the $ being sued for. 

If a reasonable financial settlement can solve the problem, most company would choose to close the case as soon as possible.
that also leaves bitter taste in executive team, a huge question mark about how your direct manager and HR handled the situation. 

I surport you to persue the case, as long as your lawyer thinks you have reasonable chance.
