file a complaint to your state insurance association, I have similar case(much more horrible, tailgate collision on highway and policeman said they did't give report unless we're in hospital and car was towed).

 in my state it's a department under state commenwealth department, they sent investigation to that insurance company(statefarm) , they changed decision right after that. Good luck!
