8 老師您好，

請教您一個問題。我太太EB2 140 很早就approaved，但去年5月downgrad to EB3，同時遞交了EB3 140 和 485，目前EB3 的140 還處於pending狀態，目前priority date 又當前了，請問在這種情況下，USCIS 處理她的485 case 嗎？
 
還是必須等EB3 的 140 approved 了才處理？
-Yes. Only I-140 is approved first, then I-485 may be approved later. Why doesn't she ask the employer to use premium processing to get the I-140 result in 15 days now? Talk to the lawyer.
