Lady J 的I-360批準後, 因為她本人和女兒在美國(女兒是Derivative child 之一), 已經遞交I-485. 然而他兒子(也是列在I-360的Derivative child)在中國, 因此FILE I-824, 要求轉NVC. 收到USCIS的RFE (見附件), 說Adjustment of status 和Consulate process不能同時進行. 不同的Beneficials(同一份 PETETION) 也不能同時處理, 對嗎?
-I think the IO is confusing when some of the beneficiaries filed I-485 and some required immigrant visa application. It is better to file I-824 for the derivative outside US after the primary beneficial and the derivative in US to get the green card, then USCIS will not be confusing.
